Terms of Service — FisuEvolution

Honest summary: it's a game. It's free. If you buy something, Apple charges you, and what you get are game items, not real money.

1. Acceptance

By downloading, installing or using FisuEvolution (the "Game") you accept these terms. If you don't agree, don't use it and delete it from your device.

The Game is developed and published by Manuel Ader. Contact details are at the end.

If you are a minor, your parent or guardian must read and accept these terms for you. If you manage a minor's device, turn on Ask to Buy and iOS Screen Time limits: they are the best way to control in-app purchases.

2. Licence

We grant you a personal, free, non-exclusive, non-transferable and revocable licence to use the Game on Apple devices you own or control, in accordance with the App Store Usage Rules.

You may not: sell, rent, sublicense or transfer the Game or your game progress; modify, decompile or reverse engineer it (except where the law expressly allows it); use bots, mods, memory editors, jailbroken devices or any other method to alter progress, the in-game economy or rewards; or redistribute its art, music, text or code.

All Game content — characters, art, music, text, branding and code — belongs to us or our licensors and stays that way. This licence transfers no ownership to you.

3. In-app purchases

The Game is free and offers optional purchases: coin and Blue Dollar packs (consumables, spent when used), the starter pack, the "No ads" option and skins (non-consumables, bought once).

  • Apple charges you. All purchases go through the App Store with your Apple Account and Apple's terms. We never see or store your payment details.
  • Refunds are handled by Apple under Apple's policies, via reportaproblem.apple.com. We cannot issue refunds or reverse a charge. If something went wrong on the Game's side, write to us anyway and we'll see what we can do.
  • Virtual items have no real-world value. Coins, Blue Dollars, skins, characters and any other in-game item are a limited licence to use them inside the Game. They are not currency, not an asset, have no monetary value, cannot be exchanged for money or goods outside the Game, and cannot be sold, transferred or inherited.
  • Restoring purchases. Non-consumable purchases (starter pack, "No ads", skins) can be restored from Settings → Restore Purchases with the same Apple Account. Consumables already spent are not restorable: they are single-use by design.
  • Progress can be lost. Your save lives on your device and, if you enable iCloud, in your private iCloud database. We keep no copy of your game: what leaves your device is, if you join the leaderboard, your name and run times (with an anonymous identifier), stored on Supabase (an Anthropic model checks the name to filter insults), and the usage statistics described in the Privacy Policy, which cannot be used to rebuild your game. If you delete the app, lose the device or turn off iCloud, your progress — including already-consumed purchased items — may be lost and we cannot recover it.
  • Reincarnating resets things on purpose. Reincarnating (prestige) wipes part of your progress in exchange for Blue Dollars and permanent multipliers. It's a game mechanic, it is shown on screen before you confirm, and it does not entitle you to a refund.
  • Prices and catalogue may change. We may add, remove or reprice products, and we may rebalance the Game (costs, earnings, rewards) at any time. Balance changes do not entitle you to a refund of past purchases.

4. Ads

The Game shows two kinds of ads:

  • Rewarded videos. Watching them is always optional: you choose to watch one in exchange for an in-game prize; they never play on their own and are never required to progress.
  • Ads that appear on their own, which may be: full-screen ads between parts of the Game, the ad break (which you can always decline) and the ad shown when you return to the app.

The "No ads" purchase — and the starter pack, which includes it — removes the ads that appear on their own. Rewarded videos stay available: they are optional and pay out prizes, and the purchase neither removes nor replaces them. How ad data is handled is explained in the Privacy Policy.

5. Content and conduct

The Game runs on Argentine humour, irony and exaggerated characters. It is fiction: any resemblance to real people, companies or institutions is parody and is not a statement of fact or advice of any kind — least of all financial, legal, tax or investment advice.

Play in good faith: no cheating, exploits, reverse engineering of the economy, or attempts to access parts of the Game or of Apple's services you are not entitled to. You are responsible for how the Game is used from your device.

The leaderboard and names

If you reach God you may enter the leaderboard with a name that other players can see. A name can be up to 15 characters (letters, numbers, spaces and . - _) and may not be offensive, discriminatory or sexual, nor contain personal data or another person's or company's brand, nor impersonate anyone. We check it with rules, a word list and an automated AI check; that check can be wrong, and we may reject, change or hide any name.

By publishing your name you accept these Terms. The game reminds you right before you publish, with a link to read them. Zero tolerance: there is no place on the leaderboard for offensive or abusive names, or names that harass other people, and anyone who uses them loses their place on the leaderboard.

Any player can report a name from the leaderboard (long-press the row). A reported name is hidden (after three reports, or earlier if we decide so) and the run stops being shown until it is reviewed. We act on reports within 24 hours and, if the name breaks these Terms, we remove it from the leaderboard. If you use the leaderboard to harass others we may remove you from it.

You can also block a name: long-press the row and choose "Hide this name" to hide it for you only. The block is stored on your device and we don't tell anyone. To report something you can't report from the game, or to ask us to delete your name, write to adermanu@gmail.com.

6. No warranties

The Game is provided "as is" and "as available", without warranties of any kind, express or implied. We do not warrant that it will run error-free or uninterrupted, that it is compatible with every device or iOS version, that your progress will be preserved, or that the Game will remain available in the future.

7. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special or consequential damages, nor for loss of progress, virtual items or data. If liability is nonetheless found, it is limited to the amount you paid inside the Game in the twelve (12) months before the event.

8. Your consumer rights

Nothing above limits or excludes the rights granted to you by Argentine Consumer Protection Act No. 24,240, or any other right your local law declares non-waivable. If any clause of these terms is held invalid, the rest remains in force.

9. Changes to these terms

We may update these terms as the Game changes or the law requires. The new version is published with its "last updated" date, and if the change is significant we announce it inside the Game. Continuing to use the Game after a change means you accept it.

10. Termination

You can end this licence at any time: delete the Game from your device. We may suspend or end it if you breach these terms — for example by cheating or manipulating the Game's economy — or if we stop publishing the Game. On termination your right to use virtual items ends as well, without compensation. Sections 2 (ownership), 6, 7, 8 and 11 survive termination.

11. Governing law and jurisdiction

These terms are governed by the laws of the Argentine Republic. Any dispute is submitted to the competent ordinary courts of the Argentine Republic, without prejudice to any forum available to you under consumer protection law.

12. Apple

Apple is not a party to these terms and has no involvement in the Game beyond distributing it and processing purchases. Apple has no obligation to provide maintenance or support for the Game. These terms are between you and us.
